1. Acceptance of Terms

By accessing or using Agent Assistant ("the Service"), operated by Real Agent Systems, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Agent Assistant provides AI-powered lead response, follow-up automation, and performance analytics for real estate professionals. The Service includes:

  • Automated speed-to-lead SMS and email response
  • Lead management and pipeline tracking
  • Performance auditing and scoring
  • Follow-up sequence automation
  • Content calendar and social media tools
  • AI voice profile for personalized communication

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service. You are responsible for all activity that occurs under your account.

4. Free Trial & Subscription

New accounts receive a 14-day free trial with full access to all features. After the trial period, continued use requires an active paid subscription. We reserve the right to change pricing with 30 days notice to existing subscribers.

5. Acceptable Use

You agree not to:

  • Use the Service to send spam, unsolicited messages, or violate CAN-SPAM, TCPA, or similar regulations
  • Upload or transmit malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service for any illegal purpose
  • Resell, sublicense, or redistribute the Service without written permission
  • Scrape, crawl, or automated-access the Service beyond normal use
  • Misrepresent your identity or affiliation

6. Messaging Compliance

You are solely responsible for compliance with all applicable messaging laws including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any state or local regulations. You must:

  • Obtain proper consent before sending automated messages to leads
  • Honor opt-out requests promptly
  • Maintain accurate records of consent
  • Not send messages to numbers on the Do Not Call Registry without prior express consent

We provide tools to help with compliance but are not responsible for your compliance with these laws.

SMS Program Terms

Agent Assistant sends automated SMS messages to leads on behalf of our subscribers. By opting in, leads consent to receive recurring automated text messages from the subscribing agent or brokerage. Message frequency varies based on lead engagement and follow-up sequences. Message and data rates may apply. Leads may opt out at any time by replying STOP to any message. Leads may reply HELP for assistance. Consent to receive SMS is not a condition of any purchase. Mobile opt-in data and phone numbers will not be shared with or sold to third parties.

7. Your Data

You retain ownership of all data you upload to the Service, including lead information, communications, and content. You grant us a limited license to process, store, and transmit your data solely to provide the Service. We will not use your data for purposes unrelated to the Service.

8. Performance Scores & Benchmarks

Our audit scores, percentile rankings, and income gap estimates are based on industry benchmarks and statistical models. They are provided for informational and educational purposes only. Actual results may vary. We do not guarantee specific outcomes, revenue increases, or lead conversion improvements.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We are not liable for any losses resulting from service downtime.

10. Limitation of Liability

To the maximum extent permitted by law, Real Agent Systems, LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Real Agent Systems, LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

12. Termination

Either party may terminate this agreement at any time. You may cancel your account through the dashboard settings or by contacting us. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.
